ASIC has released revised disclosure benchmarks and separate disclosure principles for unlisted mortgage schemes to improve awareness of the risks of investing in these products

Over the past three years since the decision in the High Court permitting litigation funding and the Federal Court’s determination that litigation funding should be treated as a managed investment scheme there has been much debate about the regulation of litigation funding in Australia.

Martin Wheatley, managing director of the Financial Services Authority (FSA), told an audience that there are still unresolved issues around how customers are treated across financial services and getting to grips with them is central to rebuilding confidence and trust.
