There needs to be a steady focus on the core values of the civil justice system so that requirements like due process and judicial independence do not get lost in the fever of economics driven reform.

ASIC needs to ensure that the regulatory regime is not harmed by private enforcement in class actions and that courts receive input on the regulator’s perspective of what is in the public interest.

It is timely to reflect on whether additional regulatory burden on advisers is likely to improve the quality and access to advice for retail consumers.
