Interpreting the EBA's powers: A case comment on the EBA's board of appeal decision 2013-008, 24 June 2013

The European Banking Authority (EBA) was introduced within the framework of the European System of Financial Supervision in 2011. It represents an important change in the supervisory structure of banks in the European Union. The scope of conferred powers enabling the Authority to promote supervisory convergence has now been the main issue of a Joint Board of Appeal decision. Developing a comprehensive legal interpretation method, the decision adds legal clarity to the powers and tasks allocated to the EBA.
