ASIC releases enforcement outcomes report for January to June 2013

ASIC has released its enforcement outcomes report for January to June 2013. It idenitifes categories of gatekeeper against whom enforcement action was taken, and highlights examples of conduct targeted during this period.

The report was issued alongside a warning that ASIC will look to key gatekeepers such as directors and innsolvency practitioners to ensure that they make appropriate decisions and uphold their obligations. In the period covered by the report, a total of 371 enforcement outcomes were achieved, comprising criminal, civil and administrative actions.

 

Significant enforcement outcomes for the period included entering into a major enforceable undertaking with Macquarie Equities Limited, the successful appealing of the suspended jail sentence of Peter Couper, the sentencing of a former Hanlong Mining executive for insider trading, and the handing down of a jail sentence to Jonathan Kur for fraud.
